Maher Escorted Tours Content Submission Terms and Conditions

By creating, modifying, transmitting, uploading, or submitting any content, you:

grant us a non-exclusive, royalty-free, fully paid, worldwide, perpetual, irrevocable, licence to publicly display, communicate to the public, and make the user content available (by all means and in any media now known or hereafter developed) to Maher Escorted Tours and other users of our services in such manner as we may permit from time to time; and

acknowledge and agree that no royalties or other remuneration will be paid or payable to you for your user content, or for the granting of the rights described above.

Video Restrictions

You represent and warrant that any content you submit:

• Does not infringe any copyright, privacy right, or any other right of any third party; (such as music tracks, snippets of copyrighted programs) without necessary authorisations, or material that violates or infringes on another’s rights including, but not limited to, privacy, publicity, and intellectual property; – see Representation of Third Parties

and

• does not contain any matter that is defamatory, offensive, unlawful, abusive or otherwise offensive, or endorses or condones any illegal, inappropriate or risky activity or behaviour

and

• does not endorse any form of hate or hate group; or depicts or involve (without limitation) any of the following: profanity or otherwise offensive language; nudity or pornographic material; derogatory characterizations of any ethnic, racial, gender, professional, age or religious groups; bigotry, racism, hatred, or harm against any group or individual or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age;

any

• does not endorse particular political agenda or message; any content that defames, misrepresents or contains disparaging remarks about other people, products or companies;

and

• does not communicates message or images inconsistent with the positive images and/or goodwill to which Maher Escorted Tours wishes to associate; or any other content that is or could be considered illegal, inappropriate, unsuitable or offensive, all as determined by Maher Escorted Tours, in its sole discretion, or that may damage the reputation of Maher Escorted Tours.

Representation of Third Parties

You will not post or submit any third party materials unless you have first obtained consent from the owner of such materials. By posting and/or submitting material or links to Maher Escorted Tours, you represent that you have the right to share the material in your submitted content, including (without limitation), intellectual property such as trademarks and creative material subject to copyright protection.

Content must be 100% original and created by you or in the public domain, and may not violate the right of privacy or publicity of, or constitute a defamation against, any person (living or deceased) or any entity;

You must obtain consent from every person who helped you create your posted materials (e.g. photographers, videographers, etc.);

You must obtain consent from every identifiable person (and his/her parent/legal guardian if he/she is under the age of 18) who appears in your posted materials (note: if you cannot obtain the appropriate consent for an identifiable individual appearing in your posted materials, then his/her face must be blurred out);

You cannot post, submit or otherwise use (in any materials you post) any music, logos, trademarks or other copyrighted materials (e.g. photographs, pictures, texts, lyrics, etc…) unless you have first obtained consent from the owner of such materials. You hereby agree to release, and hold harmless Maher Escorted Tours from and against any and all claims based on any materials you post and/or submit, including (without limitation) claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trademark infringement or any other intellectual property related cause of action.

You agree to provide Maher Escorted Tours with evidence of the above consents upon request.

You will not post or submit any personal information about yourself or third parties (e.g. addresses, phone numbers, email addresses or any other personally identifiable information) or disclose any financial information pertaining to yourself or others on the Site.

Any comments or opinions posted or otherwise expressed on the Site are those of their respective contributors only.

If we are notified that your Content infringes on another’s intellectual property rights, Maher Escorted Tours reserves the right to remove such content.

Maher Escorted Tours retains the right, but not the obligation, to remove any content that

Maher Escorted Tours believes, in its sole discretion, violates the above terms or is inappropriate in any manner.

Sharing Personal information

You will not post or submit any personal information about yourself or third parties (e.g. personal addresses, phone numbers, email addresses or any other personally identifiable information) or disclose any financial information pertaining to yourself or others on the Site.

Any comments or opinions posted or otherwise expressed on the Site are those of their respective contributors only.

Ownership of Content and Copyright

All content submitted is your sole responsibility, not Maher Escorted Tours. You retain all ownership rights over all Content, and you are solely responsible for all Content and the consequences of submitting, uploading, posting or otherwise transmitting your Content to or through us.

Licensing of Content

Maher Escorted Tours seeks to preserve any and all exemptions from liability that may be available under New Zealand copyright law.

By submitting, posting, displaying and/or uploading Content, You agree to fully indemnify and hold harmless Maher Escorted Tours, and its officers, directors, shareholders, employees, consultants, agents, and related bodies corporate from any and all third-party claims, liability, damages, and costs (including reasonable lawyers’ fees) arising from your actions or the user content that you make available.

You grant the Maher Escorted Tours and each of its, subsidiaries, licensees, successors and assigns (MET Parties), the non-exclusive, perpetual, royalty-free, no-cost license and right to use and otherwise exploit the Content and all images, text and content included or depicted therein, in whole or in part, in any manner or medium now or hereafter known or devised (including, without limitation, DVDs, streaming media, film, television, videocassettes, print, interactive devices, mobile media, Internet and on-line systems), throughout the universe and in any and all languages.

This includes giving the MET Parties the right to display, reproduce, recreate, record, perform, exhibit, distribute, copy, edit, change, modify, add to, subtract from, re-title and adapt the same, to combine it with other material and otherwise use and exploit it without having to give you any compensation or attribution. The MET Parties will have the right to make unlimited derivative works therefrom, to assign or transfer any or all such rights and to grant unlimited, multiple-level sublicenses. Without limiting the forgoing, Maher Escorted Tours will have the right to use the Content, and all images depicted therein (if any), in any merchandising, advertising, marketing, promotion or for any other commercial or non-commercial purpose. Additionally, you waive and relinquish all so-called “moral rights” (droit moral) now or hereafter recognized in connection with the Content. You understand and agree that you will not receive any compensation, including without limitation, licensing fees, royalties, payments, etc. from any MET Parties for its use of the Content.

We have no obligation to you to make this video or any user content or assets available. Maher Tours may in its absolute discretion, remove any content or assets at any time from it’s website or social media channels. We may at any time edit, refuse to display, or remove any part of your content as we deem appropriate.

All information submitted by Video Submitters will be treated according to Maher Escorted Tours privacy policy, available at http://staging-mahertoursaustralia.kinsta.cloud/about-us/privacy-policy/. By submitting content and providing your e-mail address, you hereby agree to Maher Escorted Tour’s collection and usage of their personal information and acknowledge that they have read and accepted Maher Escorted Tour’s Privacy PolicyPrivacy Policy.
